VOID WHERE PROHIBITED OR RESTRICTED BY LAW OR WHERE BONDING, REGISTRATION, OR OTHER REQUIREMENTS EXIST BUT HAVE NOT BEEN MET. AN AFFIDAVIT OF ELIGIBILITY AND RELEASE OF LIABILITY FORM MAY BE REQUIRED. BY ENTERING THIS SWEEPSTAKES, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT—READ THEM CAREFULLY BEFORE ENTERING.
ELIGIBILITY:
The “Feel Free to Play Sweepstakes” (the “Sweepstakes”) is open to legal residents of the United States (excluding residents of Florida, Nebraska, New York, Idaho, South Dakota, Puerto Rico, U.S. territories, possessions, and military installations and wherever prohibited by law) (the “Eligibility Area”) who are twenty-one (21) years or older at the time of entry.
Employees, agents, directors, and their immediate families (spouse, parents, children, siblings, and each of their spouses regardless of where they live) or members of households of Playboy Enterprises International, Inc. (“PLAYBOY”), Dipsea Inc. (“DIPSEA”), and their respective parent companies, subsidiaries, affiliates, or advertising, design, print production and publicity agencies and anyone connected with the production and distribution of the Sweepstakes (collectively, the “Sweepstakes Entities”) are not eligible to enter or be awarded a prize. The Sweepstakes is void outside the Eligibility Area and where prohibited or restricted. Odds of winning will depend upon the total number of entries received during entry period.
SPONSOR:
The sponsor and adminsitrator of the Sweepstakes is Playboy Enterprises International, Inc., 10960 Wilshire Blvd., Suite 2200, Los Angeles, CA 90024.
HOW TO ENTER:
No purchase is necessary to participate in the Sweepstakes.
To enter you must complete the following steps between Thursday, Oct. 29, 2020 at 12:00 a.m. Pacific Time (“PT”) and Friday, November 13, 2020 at 11:59 p.m. PT (the “Entry Period”).
Any eligible individual submitting a valid entry via the method below (an “Entrant”) agrees to be bound by these Official Sweepstakes Rules.
Entrant must enter their email address for a chance to win a prize by clicking on the “Join for a Chance to Win” link on the Sweepstake’s landing page that will be accessible via Pleasure For All, Playboy social sites (Instagram and Twitter), and DIPSEA digital platforms and social sites. Limit one entry per person, regardless of which of the foregoing entry methods are used.
By participating in the Sweepstakes, Entrants (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of PLAYBOY, which are final and binding in all matters relating to the Sweepstakes.
Without limitation, an Entrant may be disqualified, at PLAYBOY’s sole discretion, if: (i) Entrant fails to meet the eligibility requirements set forth above, (ii) Entrant violates or fails to comply with the Community Guidelines and Terms of Use of Instagram, these Official Rules of the Sweepstakes, and any applicable federal state, or local laws, rules, and regulations, and (iii) Entrant has a pending arrest or conviction for a felony of any kind.
Normal time, toll, connection, and usage rates, if any, charged by your Internet Service Provider may apply. Entries generated by script, macro, or other automated means are void. If the Entrant is unable to verify registration information, the Entrant will automatically be disqualified and their prize will be forfeited. PLAYBOY, in its sole discretion, reserves the right to select an alternate entry at any time. PLAYBOY is not responsible for any change of email address, mailing address and/or telephone number of entrants. PLAYBOY is not obligated to contact the Winner via any method other than that prescribed below. The Sweepstakes Entities are not responsible for and shall not be liable for late, misdirected or unsuccessful efforts to notify potential winners.
WINNER SELECTION & NOTIFICATION:
Odds of winning are based on the number of eligible entries.
One hundred (100) winners (the “Winner”) will be selected at random from the eligible entries and notified via email at the end of the Entry Period. If the Entrant is unable to verify registration information, the Entrant will automatically be disqualified and their prize will be forfeited. PLAYBOY, in its sole discretion, reserves the right to select an alternate Entrant at that time. PLAYBOY is not responsible for any change of email address, mailing address and/or telephone number of Entrants. Eligibility is subject to the entry guidelines, above, and determined in PLAYBOY’s sole and absolute discretion. PLAYBOY is not obligated to contact the Winner via any method other than that prescribed above. The Sweepstakes Entities are not responsible for and shall not be liable for late, misdirected or unsuccessful efforts to notify potential winners.
The number of eligible entries received determines the odds of winning. In the event of a dispute regarding the identity of the person submitting the entry, the entry will be deemed to have been submitted by the person in whose name the entrant’s email address is registered. Winners will be selected at random from the eligible entries and will be notified via email after the end of the Entry Period. Sponsor reserves the right to determine and to alter the method of notification.
PRIZE(S):
Potential prize winners will be selected from all eligible entries submitted to receive one (1) each of the following:
- One (1) Playboy CBD Bundle to consist of a CBD Intimacy Gel, CBD Arousal Spray and CBD Bath Bomb; and
- A free one (1) year subscription to the erotic audio platform, www.dipseastories.com.
Each Winner will be awarded one (1) Prize as described above. The Prizes are nontransferable and may not be resold in any manner. No cash or other substitutions will be offered. All federal, state and local taxes are the sole responsibility of the winner. PLAYBOY has the right to substitute a prize of equal or greater value if listed prize is unavailable. Any and all taxes, or any other expenses associated with the set up and/or use of the Prizes are responsibility of the winners.
APPROXIMATE RETAIL VALUE:
The individual total approximate retail value (“ARV”) for one (1) individual Prize is One Hundred Fifty-Four US Dollars and Ninety-Nine Cents ($154.99) which represents the following retail values: Forty- Seven US Dollars ($47.00) for the Intimacy Gel, Forty-Five US dollars ($45.00) for the Arousal Spray, Fifteen US dollars ($15.00) for the Bath Bomb, and Forty-Seven US dollars and Ninety-Nine cents ($47.99) for the one year subscription to www.dipseastories.com. Total cumulative ARV for all 100 Prizes to be awarded during the Sweepstakes is: Fifteen Thousand Four Hundred and Ninety-Nine U.S. Dollars ($15,499.00).
PRIZE FULFILLMENT:
One Prize per winner will be awarded within approximately 6-8 weeks after the Winner is verified. Winner must provide the following information to PLAYBOY in order to receive the Prize: full legal name, mailing address, telephone number(s), age and date of birth. Arrangements for Prize fulfillment will be made by PLAYBOY in its sole discretion. PLAYBOY reserves the right, in its sole discretion, to substitute a prize of greater or equal value.
Prize is awarded “as is” with no warranty or guarantee, either express or implied by PLAYBOY or any Sweepstakes Entity. Winners acknowledge that the Sweepstakes Entities and all other businesses affiliated with this Sweepstakes and their agents do not make, nor are in any manner responsible for, any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the Prize being offered.
Conditions and restrictions may apply. The right to receive the Prize is non-assignable and non-transferable. No Prize substitution, exchange or cash equivalent will be allowed except by PLAYBOY, who reserves the right to substitute the Prize (or portion of the Prize) with another prize of equal or greater value in case of unavailability of Prize or force majeure.
If notification is, in PLAYBOY’s determination, somehow undeliverable or if the selected Winner cannot accept or receive the Prize for any reason, or he/she is not in compliance with these Official Rules, the Prize will be forfeited and an alternate Winner may be selected in a separate random drawing.
By accepting the Prize, Winner waives the right to 1) assert as a cost of winning the Prize any and all costs of verification and redemption to redeem the Prize, and 2) claim any liability (including attorneys’ fees and costs) which might arise from redeeming or seeking to redeem the Prize (including any travel related thereto, if applicable). Winner is responsible for all federal, state, local and income taxes associated with winning a prize. Winner also accepts sole responsibility for any miscellaneous costs relating to acceptance of the Prize.
GENERAL RULES:
Sweepstakes administration, Winner selection and Prize claim verification will be conducted by PLAYBOY. By participating in the Sweepstakes, Entrant agrees to be bound by these Official Rules and the decisions of PLAYBOY, whose decisions are final and binding. All materials submitted become the sole property of PLAYBOY and will not be returned. Return of Prize as undeliverable will result in disqualification, and an alternate Winner may be selected in PLAYBOY’S sole discretion. Winner must sign and return an Affidavit of Eligibility and Publicity/Liability Release within five (5) business days of receiving the notification from PLAYBOY. Noncompliance within this time period will result in disqualification and an alternate Winner maybe selected in PLAYBOY’S sole discretion.
Each Entrant explicitly releases and holds harmless the Sweepstakes Entities, their successors, estates and assigns and all their respective shareholders, directors, officers and employees, one and all, from any and all liability, actions, causes of action, damages, actual, incidental or consequential, claims and demands whatsoever in law or equity, which he/she now has or may acquire, by reason of any personal injury, death, loss of, or damage to, property, or any reason, occurring during or arising out of his/her participation in the Sweepstakes and the acceptance and use or misuse of Prize.
Each Entrant further agrees that in the event of any third party claims, damages, losses or injuries, arising from or relating to this Sweepstakes, Entrant will defend, indemnify and hold harmless the Sweepstakes Entities, their successors, estates and assigns and all their respective shareholders, directors, officers and employees, from any and all such claims, including the attorney’s fees related thereto.
If any provision of the Sweepstakes is deemed to violate any federal, state or local law, it shall be amended to conform to such law and all other provisions shall remain in full force and effect.
PLAYBOY reserves the right, in its sole discretion, to cancel/terminate, modify or suspend the Sweepstakes if, in PLAYBOY’S sole determination, the integrity of the Sweepstakes has been, or could be, compromised or the Sweepstakes is not capable of running as planned or fairly, including, but not limited to, fraud or force majeure or any other cause beyond PLAYBOY’S control at which time, PLAYBOY will conduct a random drawing from among all eligible entries received at the time of the Sweepstakes termination.
All entries have an equal chance of winning. All entries become the property of PLAYBOY and will not be acknowledged or returned. Entry materials/data that have been tampered with or altered, mass entries, or entries generated by a script, macro or use of automated devices are void, and will not be considered eligible pursuant to these Official Rules.
None of the Sweepstakes Entities shall be responsible for: (i) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive information by PLAYBOY on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; or (ii) any injury or damage to Entrant’s or any other person’s computer related to or resulting from participating in the Sweepstakes.
Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. PLAYBOY reserves the right to: (i) permanently disqualify from any promotion it sponsors any person it believes has intentionally violated these Official Rules; and (ii) withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes), and to select winners from among all eligible entries received prior to withdrawal.
PLAYBOY reserves the right, in its sole discretion, to suspend, modify, or terminate the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, PLAYBOY reserves the right, in its sole discretion, to award the Prize based on the entries received before the termination date.
DISPUTES:
The Sweepstakes shall be governed by and interpreted under the laws of the State of California, USA, without regard to its conflicts of laws or provisions. Entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes or the award of the Prize and all issues and questions concerning the validity, interpretation and enforceability of these Official Rules shall be resolved individually, without resort to any form of class action, and exclusively in a court of competent jurisdiction sitting in Los Angeles County, California, USA. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes and never shall include consequential, incidental or punitive damages and, in no event, attorneys' fees. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
RELEASE, LIMITATIONS OF LIABILITY AND PRIVACY:
Acceptance of the Prize constitutes permission to use Winner's name, town and state, voice and likeness and any and all identifying characteristics including, but not limited to, the taking of photographs and/or videos, etc. by Sweepstakes Entities’ photographers or videographers for publicity purposes, in perpetuity, in all media, without further consent or compensation, unless prohibited by law, and Winner agrees to execute any and all documents requested by Sweepstakes Entities to convey such rights to own all the results thereof. Nothing contained herein shall be deemed to obligate any of the Sweepstakes Entities to make use of any of the rights granted herein, and Winner waives any right to inspect or approve any such use of any and every nature and kind.
None of the Sweepstakes Entities shall be responsible for late, lost, damaged, misdirected, incorrectly addressed, stolen, incomplete, illegible, undeliverable, destroyed entries, nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, nor for technical, network, telephone equipment, electronic, computer hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry materials by PLAYBOY on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. None of the Sweepstakes Entities shall be responsible for technical issues of any kind which interfere with or prevent PLAYBOY from notifying the Winner. Any person attempting to alter, modify or damage, or any website, defraud or in any way tamper with the Sweepstakes will be ineligible for the Prize and may be prosecuted to the full extent of the law. None of the Sweepstakes Entities shall be responsible for technical, pictorial, typographical or editorial errors or omissions in any marketing materials or these Official Rules.
By participating in the Sweepstakes, each Entrant waives any and all claims of liability or causes of action against the Sweepstakes Entities, and their respective employees and agents, for any personal injury, illness, damage, or loss which may occur from the conduct of, or participation in, the Sweepstakes, or from the award, receipt and/or use or misuse of any Prize, including any travel related thereto. In order to receive the Prize, the Winner must sign official waivers provided by PLAYBOY.
By entering and providing the required entry information, Entrant acknowledges and agrees to accept terms of PLAYBOY’S privacy policy, which can be found at http://www.playboy.com/privacy-policy, and, as applicable, the terms of DIPSEA’s privacy policy, which can be found at https://www.dipseastories.com/privacypolicy/. Consenting to receive any emails from the Sweepstakes Entities is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes and does not improve your chances of winning. This offer may not be reproduced, reprinted or published elsewhere in any format without the written permission of PLAYBOY.
